Local 1221

Article I

Name

The name of this organization shall be Washington State Employees, Spokane Area, Local Number 1221 of the American Federation of State, County and Municipal Employees, AFL-CIO.

Article Il

Affiliations

This union shall be affiliated with the Washington Federation of State Employees Council No. 28 of the American Federation of State, County and Municipal Employees; the Washington State Labor Council, AFL-CIO; and the Spokane Regional Labor Council, AFLCIO.

Article Ill

Objectives

The objectives of this local union shall be to carry out on a local basis the objectives of the American Federation of State, County and Municipal Employees.

Article IV

Membership and Dues

Section 1. All Spokane area employees of the state of Washington, and employees of American Behavioral Health Systems Inc., excluding those employees within the jurisdiction of locals 504, 573, 782 and 931, and statewide locals in the area, are eligible for membership in this local union, subject to the requirements of the constitution of the International Union.

Section 2. Application for membership shall be made on a standard application form. Unless such form includes a valid authorization for payroll deduction of dues, the application shall be accompanied by the current month's dues.

Section 3. The monthly membership dues of this local shall be set in accordance with Article VI, Section 1, of the Council 28 Constitution.

Section 4. Membership dues shall be payable to the Washington Federation of State Employees Council No. 28, AFL-CIO, through payroll deduction, except where payroll deduction is not available or applicable. Where payroll deduction is not available or applicable, membership dues shall be payable no later than the 15th of the month following the month on which they are based. Any member who fails to pay dues by the 15th day of the month in which they become due shall be considered delinquent, and upon failure to pay dues for two successive months shall stand suspended. Provided, however, that any person who is paying dues through a system of regular payroll deduction shall for so long as such person continues to pay through such deduction method, be considered in good standing.

Section 5. A member suspended under the above section may be reinstated to membership in the local on payment of all arrearages or, where available, a written agreement to pay all arrearages through payroll deduction.

Article V

Meetings

Section 1. Regular meetings of this local shall be held once each month, ata time and place to be fixed by the membership or the local executive board.

Section 2. Special meetings may be called by the local president, the local executive board, or by petition filed with the president and signed by at least 10 members in good standing. Special meetings may also be called by the International President or his/her authorized representatives.

Section 3. The quorum for meetings of this local shall be 15 members in good standing.

Section 4. The local union executive board shall meet monthly at a time and place to be fixed by the members of the executive board.

Section 5. Special meetings of the executive board may be called by the president or a majority of the executive board. A special meeting may also be called by the International President or his/her authorized representative.

Article VI

Officers, Trustees, Delegates, Nominations and Elections

Section 1. The officers of this local shall be a president, a vice-president, a recording secretary, a secretary-treasurer, and one executive board member from each policy committee (Institutions, Human Services, Transportation, Institutions of Higher Education, Department of Labor and Industries, Employment Security, Miscellaneous Code Departments and Elective Officials, Corrections, Natural Resources and Public Service), based on the policy committees listed in the current Council 28 Constitution at the time of nominations. These 14 officers shall constitute the Local 1221 executive board. In addition, there shall be elected three members who shall serve as trustees, The trustees shall be elected to overlapping three-year terms of office, with one term expiring each year. All other officers shall be elected for a term of two years in the even-numbered years, beginning in 2014.

Section 2. Local 1221 executive board members from each policy committee and Local 1221 delegates/alternates for Council 28 policy committees nominated shall be elected by members of their own respective policy committee. Delegates and alternates to the conventions of the Spokane Regional Labor Council and to the Washington State Labor Council, Council 28 and the International shall be elected in accordance with the AFSCME election code regarding election of delegates.

Section 3. Nominations shall be made at a regular or special meeting of the local. At least fifteen days' advance notice shall be given the membership prior to the nomination meeting. A nominating committee may be appointed or elected to make nominations, but whether or not such nominating committee is used, nominations shall be permitted from the floor at the nomination meeting. Nominations for officers, trustees and Spokane Regional Labor Council delegates/alternates will occur in the month of September, in the even-numbered years. Elections for officers, trustees and Spokane Regional Labor Council delegates/alternates will occur in the month of October, in the even-numbered years. Officers' terms of office shall begin immediately upon acceptance of the Election Committee's general report. Local 1221 Policy Committee delegates/alternates nominations and elections will occur no earlier than 30 days prior to the Council 28 biennial convention and no later than 15 days after the convention. Policy Committee delegates/alternates will be elected for a two-year term. Policy Committee delegates/alternates terms of office shall begin with the first Policy Committee meeting held within 60 days of adjournment of the biennial convention of Council 28 and ending upon adjournment of the next biennial convention.

Section 4. To be eligible for office, a member must be in good standing for one year immediately preceding the election, except in the initial election held in this local; provided, however, that no retired member shall be a candidate for office. For a member who is transferred or promoted into this local from another AFSCME Council 28 (WFSE) local, this

requirement shall be satisfied if such member's combined membership in good standing in both locals is twelve (12) consecutive months immediately preceding the nomination.

Section 5. Officers, delegates/alternates and trustees of this local shall be elected by secret ballot vote, and the balloting shall be so conducted as to afford to all members a reasonable opportunity to vote. At least fifteen days' advance notice shall be given the membership prior to the holding of the election.

Section 6. All matters concerning nominations and elections in this local union shall be subject to the provisions of Appendix D, entitled Elections Code, of the International Union Constitution.

Section 7. Vacancies in office of vice-president, recording secretary, secretary-treasurer, executive board members or trustees shall be filled for the remainder of the unexpired term by vote of the executive board. In the event the office of president falls vacant, the vice-president shall become the president for the remainder of the unexpired term and the office of vicepresident shall be filled for the remainder of the unexpired term by vote of the executive board. The executive board shall consider a position vacant if an officer misses three consecutive meetings without good cause. Good cause shall be determined by the local executive board.

Section 8. In the event that an executive board member is elected, pursuant to the provisions of Section 5, 6 and 7 of this Article, to fill a vacancy in the office of vice-president, recording secretary, secretary-treasurer or trustee, he/she shall resign their original executive board office.

Section 9. Officers shall attend regular meetings, executive board meetings and Grievance Committee meetings. Three consecutive, unexcused absences shall result in the office being declared vacant.

Section 10. Every officer shall, upon assuming office, subscribe to the Obligation of an Officer contained in Appendix B of the International Union Constitution.

Section 11. All officers shall be bonded in the amount of at least ten percent of the assets handled annually by the local, as per Article IX, Section 30, of the Intemational Constitution.

Article

Duties of Officers and Executive Board

Section 1.        The president shall:

  1. preside at all regular and special meetings of the local union and of the executive board.
  2. be a member of all committees except election committees.
  3. be an automatic delegate to the regularly scheduled International Convention, the Council 28 convention and the Washington State Labor Council convention.
  4. be, or his/her designee, a member of the Spokane Regional Labor Council Executive Council.

                       countersign all checks drawn against the funds of the local.

 appoint all standing committees and all special committees of the local, subject to the approval of the executive board.

g. report periodically to the membership regarding the progress and standing of the local and regarding the president's official acts.

Section 2.     The vice-president shall:

  1. assist the president in the work of the president's office.

  1. in the absence of the president or in the president's inability to serve, preside at all meetings and perform all duties otherwise performed by the president.
  2. upon approval by the local executive board, be authorized to act as co-signer of checks drawn on the local funds in place of either the president or the secretarytreasurer.

Section 3.         The recording secretary shall:

  1. keep a record of the proceedings of all membership meetings and of all executive board meetings.
  2. carry on the official correspondence of the local, except as the executive board may direct otherwise.
  3. upon approval by the local executive board, authorize to act as co-signer of checks drawn on the local funds in place of either the president or secretarytreasurer.
  4. perform such other duties as the executive board may require.

Section 4.         The secretary-treasurer shall:

  1. receive and receipt for all monies of the local union.
  2. deposit all money so received in the name of the local union in a bank or banks selected by the executive board, and money so deposited shall be withdrawn only by check signed by the president and the secretary-treasurer.
  3. prepare and sign checks for such purposes as are required by the constitution or are authorized by the membership or the executive board.
  4. prepare and submit the monthly membership report to the International Union office and see that a check is drawn in payment of the local's per capita tax each month and sent to the International Secretary-Treasurer.

 keep an accurate record of receipts and disbursements and shall, once each month, submit to the membership a monthly operating statement of the financial transactions of the local for the previous month.

                       act as custodian of all properties of the local union.

  1. give a surety bond for an amount to be fixed by the executive board of the local union, at the expense of the local union and through the International Union.
  2. see that any financial reports required by the International Union Constitution to be submitted to the International Union are submitted in accordance with the International Union Constitution.

Section 5. The trustees shall make or cause to be made at least semi-annually an audit of

the finances of the local, including the finances concerning any health and welfare, pension, insurance or other benefit programs covering members of such local, and shall report to the membership on the results of such audit.

Section 6. The executive board shall be the governing body of the local union except when meetings of the local union are in session. All matters affecting the policies, aims and means of accomplishing the purposes of the local not specifically provided for in this constitution or by action of the membership at a regular or special meeting shall be decided by the executive board. The board shall meet at the call of the president or of a majority of the members of the board. A report on all actions taken by the executive board shall be made to the membership at the next following meeting. A majority of the members of the executive board shall be required for a quorum. Executive board members will serve on the Grievance Committee and at least one other standing committee.

Section 7. Each worksite agency unit may elect its own chief steward. The nominations and elections will be in accordance to Article V. If the chief steward fails to perform duties of his/her position, a majority of the members of the worksite agency unit shall have the right to request that the local president approve immediate appointment of a new chief steward for that worksite agency unit.

Article Vill

Miscellaneous Provisions

Section 1. This local union shall at all times be subject to the provisions of the constitution of the American Federation of State, County and Municipal Employees.

Section 2. Except to the extent specified in this constitution, no officer of the local union shall have the power to act as agent for or otherwise bind the local union in any way whatsoever. No member or group of members or other person or persons shall have the power to act on behalf of or otherwise bind the local union except to the extent specifically authorized in writing by the president of the local union or by the executive board of the local union.

Section 3. The rules contained in the current edition of Robert's Rules of Order, Newly Revised, shall govern this local union in all cases to which they are applicable and in which they are not inconsistent with this constitution and special rules of this local union or of the American Federation of State, County and Municipal Employees.

Section 4. All judicial procedures shall be conducted in accordance with Article X of the International Constitution.

Section 5. A copy of the constitution and any constitutional amendments governing this local shall be available to all members of this local.

Article IX

Amendments

This constitution may be amended, revised, or otherwise changed by a two-thirds vote of the members voting on such proposed change and such change shall take effect only upon written approval of the International President. Proposed amendments to this constitution must be read at a regular or special meeting of the local union and read and voted on at a subsequent meeting of the local union, adequate and proper notice having been given to the membership prior to the date on which the vote is taken. A written copy of the proposed amendment shall be furnished to every eligible voter at the meeting at which the vote is taken.

Dear Brother Mallery:

We have completed our review of the revised Local 1221 Constitution, which was submitted by AFSCME Council 28 Director of Administration Liz Larsen on your behalf. We appreciate your patience and her assistance while we completed this process. The constitution has been approved with the following exceptions and/or revisions:

1 . Article VI, Section 1. We have approved officer and term language. For clarity, we have revised this section as follows: "The officers of this local shall be a president, a vice-president, a recording secretary, a secretarytreasurer, and one executive board member from each policy committee (Institutions, Human Services, Transportation, Institutions of Higher

Education, Department of Labor and Industries, Employment Security,

Miscellaneous Code Departments and Elective Officials, Corrections, Natural Resources and Public Service), based on the policy committees listed in the current Council 28 Constitution at the time of nominations. These 14 officers shall constitute the Local 1221 executive board. In addition, there shall be elected three members who shall serve as trustees.   1. Article VI, Section 9. While we approved proposed language regarding unexcused absences from meetings, we made the following exception: We deleted "during the term of office." Officers can only be removed from office for three consecutive unexcused absences from meetings. The local cannot use the limitation of an office term as a criterion to remove officers for unexcused absences.
  2. Article VI', Section 4d. We have retained language from the previously approved Local 1221 Constitution regarding per capita tax and membership reporting. Though Council 28 may perform these functions

on behalf of the local, it remains the local's responsibility to see that such reporting occurs.

Enclosed are two complete copies of the local constitution, as amended, with my signature of approval on the final page. Should the local amend this constitution in the future, please submit the amendments for approval after they have been adopted by the membership.
